The Distinct You online real fur store is accessing this website, you agree to comply with and are bound by the following terms and conditions. We reserve the right to change or update them at any time. These changes will be in effect as per the date of when the revised draft was posted.
We are allowed to accept the buyer’s purchase offer and will be bound to supply the goods in accordance with the terms and conditions. Your order will be confirmed with an acknowledgment hard copy or acceptable electronic transmission. We also hold the right to reject any incoming order for any reason.
All prices on our website are quoted on a per-dollar basis, unless it is otherwise indicated on the invoice. The buyer is responsible for any government charges or tax that is imposed on the transfer or sale of the products.
Unless otherwise agreed in writing by Distinct You, delivery dates for all products and services are estimates. While we strive to send the products in the estimated time of arrival, in no case will sellers be liable for any loss, expense, or damage to the buyer as a result of failure in delivering by specified dates. In any unforeseen circumstances causing the late delivery, we will make an effort to inform you beforehand so that you are prepared.
The route and method for the shipper are at Distinct You’s discretion. The ownership of the product passes onto the buyer when it is delivered to selected carriers, even if a nonconforming tender was confirmed. Any attempts to revoke the acceptance of the product are invalid.
Buyer may cancel any order made with and approved by Distinct You with our consent and conditions that protect the Seller against any damage. Distinct You will not approve order cancellations after an order is delivered to a courier without imposing a 25% cancellation charge to cover recovery expenses.
We will not take cancellations of non-price, non-standard list items placed on special orders. If Buyer significantly violates this contract, it is entitled to bankruptcy protection or is the subject of liquidation, receivership, dissolution, or a similar process, Seller may cancel all or any portion of this order and cease performance hereunder without obligation to Buyer.
Distinct You warrants that all purchased products are free from defects when it comes to workmanship and materials at the delivery time. If an analysis is presented on the invoice, it is not meant to be a thorough analysis and should not be construed as a specification or guarantee unless otherwise indicated in writing.
The Buyer recognizes and accepts that the seller’s responsibility for any claims relating to the items is limited to the amount spent by the Buyer for such products as stated on the invoice. Even if the seller’s responsibility is attributable in part or in whole to its own carelessness, the restrictions on the Seller’s liability set out above will apply. Any action brought on behalf of or by Buyer, its successors, or assigns for violation of this contract must be filed within one (1) year of the occurrence of the cause of action.
Buyer has 10 business days after receiving the Product to examine it and inform Seller in writing of any defects or other reasons for rejection. Buyer acknowledges that a 10 business day inspection period gives a fair time for Buyer to examine the Product. This message must include every reason for the Product’s rejection. Buyer’s failure to reject the Product within the 10 business day period constitutes a waiver of Buyer’s inspection right as well as Buyer’s unconditional and irreversible acceptance of the Product.
Buyer shall hold, indemnify, or defend harmless Seller against or from all claims, liability, losses, expenses, or damage including, but not limited to the cost of defense or attorney fees that arise from, are connected with, or related to any asserted defects or deficiencies in the product caused by the modification or alteration by the buyer without or with the Seller’s consent, or the improper storage or handling by Buyer, a breach of the terms and conditions, Buyer’s failure to label the product, or the Buyer’s improper labeling of the product, whether done without or with the Seller’s advice, or any act or omission of Buyer, including any claims for or causing any injury to person (including death), economic loss, or property damage, comparative or several negligences, breach of warranty, breach of agreement, or other breaches of duty of or by Indemnitee, or as a result of Indemnitee’s strict or ot strict liability. The preceding indemnity is not intended to replace or limit any other legal indemnification or right that Indemnitee may have.
Buyer needs to make the payment for the Distinct Your fur web store within 20 business days from the date of the invoice order. Any amounts after the 20 business days are overdue and can be cancelled without notification by Distinct You.
Any tax or governmental fee imposed on the transfer or sale of any goods is the responsibility of the buyer. The overall billing amount does not include any such governmental fee or tax. Tax is not included in any of the prices on our fur online shop. Distinct You have no responsibility or authority to inform purchasers of the tax amount. The tax rate varies depending on the goods and the buyer’s country and region. Freight expenses will be applied to the invoice as needed.
